NE Pool Service – Service and Trading Terms and Conditions 2024
Definitions: Key terms used in the agreement are defined, including "We" or "Us" (NE Pool Service), "You" (the customer), "Goods" (items provided by us), "Services" (work performed by us), and "Agreement" (the arrangement for purchasing goods and services on credit, subject to modifications).
Provision of Goods and Services:
We may offer goods and services for purchase based on these terms, but we are not obligated to fulfill every request made by you.
Quotes and Orders:
Any quote or price provided is not an offer to sell. We may adjust these prices, giving notice of any changes. When you place an order for goods or services, it is a binding offer, and our fulfillment of the order signifies acceptance.
Pricing and GST:
All prices provided include Goods and Services Tax (GST).
Payment Terms:
Payment for goods and services provided on credit is due on invoice (Within 24hours) of the invoice date, unless otherwise agreed. If payment is not made on time, we may:

Charge a fee for dishonoured payments.

Recover any costs associated with collecting overdue payments, including legal and collection agency fees.

Halt further supply. Any previous leniency in enforcing these penalties does not prevent us from doing so in the future.

Only continue supply with you signing up to a pre-approved card facility or prepaid capped price service option. This option will only be provided at our whole discretion and is not guaranteed.
Ownership of Goods:
Title to the goods remains with us until full payment has been made. In the event of non-payment, we may repossess the goods and recover the costs involved or cancel the agreement.
Default Events:
You will be in default if:

You fail to pay on time.

You breach any part of this agreement and do not resolve the issue within seven days of receiving notice.

You become bankrupt or have a trustee, receiver, or similar official appointed over your property.

You are a company facing liquidation or have a receiver or other officer appointed over your assets.
Claims and Responsibilities:
Any claims regarding breaches of these terms must be submitted in writing within seven days of the invoice. We acknowledge that certain rights and warranties are implied by the Competition and Consumer Act 2010, and these terms do not seek to limit or exclude those statutory obligations.
Repair Process and Warranty:
Before conducting any repairs, we will provide a quote, which may involve disassembling the equipment. A fee may be charged for the quote if repairs are not pursued, and equipment may be returned, unassembled. If no instructions are received within 90 days of providing the quote, we may dispose of the equipment at our discretion. Repaired items are warranted against defects in materials or workmanship for 3 months, except for damage caused by misuse or improper installation.
Entire Agreement:
These terms represent the complete agreement between the parties, replacing all prior agreements or arrangements.
Suspension of Supply:
We reserve the right to stop or suspend supplying goods and services if we have concerns about your ability to pay or comply with these terms, without notice. We will not be liable for any losses or damages you may incur because of such a suspension.
Rain and Storms:
If your service is scheduled on a day it rains and we can safely access your pool, we will downgrade your service to our Express service where we test your water and add basic chemicals to keep it balanced until your next service. If it is unsafe to work, we will re-schedule your service to the next timeslot we have available.
Service Times:
Your service may be carried out at anytime from 6am to 6pm Monday to Friday. We are unable to accommodate specific time requests. We always will try our best to give a Morning time (6am to 12noon or Afternoon time (12noon to 6pm) but with many variables in our day, it is our preference to not run to times.
Service Rescheduling and Property Access:
If your service is scheduled and you request us to delay the service, we cannot guarantee we will have the space to do so, and you may have to wait until your next scheduled service.
If we attend your property as scheduled, and we cannot gain access to the pool, we will not be able to reattend it until your next scheduled service. If this occurs multiple times, we may charge a call out fee or cancel your service without notice.
Water Levels:
If we attend your property, and the pool has insufficient water to vacuum and backwash, we will downgrade your service Our express service and add chemicals to help prevent the pool turning green.
Pool Equipment (Pool of serviceable standard):
If your pool equipment is not working correctly, and we have quoted a replacement/repair option and you have chosen not to carry out these repairs/replacement, we may choose to cancel your service as it will be deemed to be of unserviceable nature.
Staff:
Where we employ a staff member, we will ensure that the person attending your service has had required training from us, along with any appropriate checks required, carried out on them.
Photography:
During your service, we may at times take photos of your pool, equipment and surrounds. Unless otherwise advised in writing, we reserve the right to store these images and use them on our social media for advertising without further consent. No identifiable information will be disclosed in doing so.
